Terms of Service

These Terms of Service govern access to and use of the MMSwitchboard website, platform, related services, communications and support offerings. By using our website or services, you agree to these terms to the extent applicable.

1. About these terms

These terms are intended to provide a practical legal framework for the use of MMSwitchboard services. They may be supplemented by quotations, proposals, onboarding documents, service schedules, acceptable use rules, channel provider terms or written agreements where applicable.

2. Services

MMSwitchboard provides business communication tools and related services that may include shared inbox capabilities, routing, conversation assignment, messaging integrations, automation features, reporting, onboarding and support services.

Service features, channel availability and package scope may vary depending on your selected plan, technical configuration, third-party provider support and operational readiness.

3. Eligibility and authority

If you use MMSwitchboard on behalf of a company, organisation or other entity, you confirm that you have the authority to act on its behalf and to bind that entity to these terms where relevant.

4. Account and access responsibilities

You are responsible for:

  • providing accurate onboarding and account information
  • keeping login credentials secure and confidential
  • managing internal user permissions appropriately
  • ensuring your systems, devices and staff use the service responsibly
  • promptly notifying us of suspected unauthorised access or misuse

5. Acceptable use

You may not use MMSwitchboard for unlawful, abusive, deceptive or harmful purposes, including:

  • sending spam, fraudulent or misleading communications
  • infringing intellectual property or privacy rights
  • attempting to bypass platform restrictions, security or technical safeguards
  • distributing malicious code, harmful content or unauthorised material
  • using the platform in a way that damages our systems, reputation or third-party relationships

6. Third-party channels and providers

Some MMSwitchboard features may depend on third-party communication channels, APIs, carriers, hosting providers, social platforms, messaging platforms, infrastructure services or software vendors. Those services may impose their own rules, approval processes, fees, technical limits, template rules, quality requirements and suspension rights.

MMSwitchboard is not responsible for the acts, outages, restrictions, policy changes or approval decisions of third-party providers.

7. Fees, billing and usage

Fees, included message volumes, setup costs, support scope and recurring charges will depend on the selected package or agreement. Additional usage, premium services, add-ons, onboarding work or third-party costs may be billed separately where applicable.

  • Amounts due must be paid in accordance with agreed payment terms.
  • Late payment may result in service restriction, suspension or delayed support.
  • Trials, promotional offers or introductory pricing may be limited or withdrawn.

8. Suspension and termination

We may suspend, restrict or terminate access where reasonably necessary, including for non-payment, abuse, security concerns, legal risk, operational risk, third-party provider action or violation of these terms.

You may stop using the service subject to any applicable notice periods, billing commitments, contract terms or outstanding amounts due.

9. Data and privacy

Use of personal information is also governed by our Privacy Policy. You remain responsible for ensuring that your own use of customer, staff or third-party data through the platform complies with applicable law and your own notices, permissions and operational obligations.

10. Intellectual property

MMSwitchboard, its branding, designs, website content, documentation, workflows, interface elements and related materials remain our property or the property of our licensors unless expressly agreed otherwise in writing. These terms do not transfer ownership of intellectual property rights to you.

11. Warranties and service availability

MMSwitchboard aims to provide a practical, reliable service, but services are provided on an “as available” basis unless a written service commitment states otherwise. We do not guarantee uninterrupted uptime, message delivery performance, platform availability, approval by third parties or fitness for every specific business use case.

12. Limitation of liability

To the maximum extent permitted by law, MMSwitchboard will not be liable for indirect, incidental, special, consequential or loss-of-profit damages, or for losses arising from third-party provider failures, outages, policy changes, message delivery failures, delays, data loss, customer misuse or events beyond reasonable control.

Any direct liability, where legally applicable, will be limited to the amount paid by the customer for the affected services during the relevant period, unless a different written agreement applies.

13. Changes to the service or terms

We may update these terms, service features, plans, documentation or operational requirements from time to time. The latest published version of these terms will apply from the effective date shown on this page unless a written agreement states otherwise.

14. Governing law

These terms are intended to be governed by and interpreted in accordance with the laws of the Republic of South Africa, subject to any mandatory legal requirements that may apply.
